In pursuance of Establishment Order No. 85/2007 dated 25.06.2007 read with Corrigendum dated 03.12.2007 issued from F. No. 39/01/2007-Estt by the Additional Commissioner (P&V), Central Excise and Customs, Vadodara-I, the following Inspectors are hereby granted 1st financial upgradation in the pay scale of Rs. 7500-250-12000 with effect from the date of completion of 12 years (in case of 1st Financial Up gradation) in regular service or 09.08.1999 whichever is later.  The Financial Upgradation is granted subject to terms and instructions laid down under Government of India, Ministry of Personnel, Public Grievance & Pensions (Deptt. of Personnel & Training), New Delhi’s OM No. 35034/1/97-Estt.(D) dated 09.08.1999 read with Ministry of Finance, Department of Revenue’s Circular No. 131/99 F. No. 12/98/99-Coord Dated 12.08.1999 and F. No. A-32011/8/98-AD.IIIA dated 23.08.1999 and 28.02.2000.

The Financial benefit granted to the above officers is subject to the following terms and conditions :

 

1)         The ACP Scheme envisages merely placement in the higher pay scale / grant of financial benefits (through financial upgradation) only to the Government Servant concerned on personal basis and shall therefore, neither amount to functional / regular promotion nor would require creation of new posts for the purpose.

 

2)         The financial upgradation granted under the ACP Scheme shall be counted against regular promotion.

 

3)         The residency period (regular service) for grant of benefits under ACP scheme shall be counted from the grade in which an employee was appointed as Direct Recruit.

 

4)         The financial upgradation granted is personal to incumbents for the stated purposes of the ACP scheme and is restricted for financial and certain other benefits (House Building Advances / Allotments of Govt. Accommodation / Advances etc.) only without conferring any privileges related to higher status. (e.g.) invitation to ceremonial functions, deputation to higher post etc.

 

5)         The financial upgradation under the ACP scheme granted to above officers is personnel to them and has no relevance to seniority and there shall be no additional financial upgradation for the seniors on the ground that their junior employee in the grade has got higher pay scale under the ACP Scheme.

 

6)         The pay of the above officer shall be fixed under the provisions of FR – 22(1)a (1) subject to minimum financial benefit of Rs. 100/- as per Department of Personnel and Training’s Order No.  1/6/97-Pay.I dated 05.07.1999.  The financial benefit allowed under ACP Scheme is final and no pay fixation benefits shall accrue at the time of regular promotion i.e. posting against functional post in the higher grade.

 

7)         Grant of higher pay scale under the ACP Scheme shall be conditional to the fact that an employee, while accepting the said benefit, shall be deemed to have given his unqualified acceptance for regular promotion on occurrence of vacancy subsequently.  In case if any officer refuses to accept the higher post on regular promotion subsequently, he shall be subject to normal debarment for regular promotion as prescribed in the general instructions in this regard.  However, as and when he accepts regular promotion thereafter, he shall become eligible for second upgradation under the ACP Scheme only after he completes the required eligibility, service period under the ACP scheme in the higher grade subject to the condition that the period for which he was debarred for regular promotion shall not count for the purpose.

 

8)         Before granting ACP benefit, the period of suspension of officers if any,  may please be excluded.

 

9)         In the case of officers listed above who re on deputation, in view of the D.O.P.T.’s O.M. No. 22034/5/2000-Estt(D) dated 20th August, 2001 modifying the clarification No. 29 in the D.O.P.T.’s O.M. dated 10.02.2000, he is allowed to opt to draw pay in the higher scale of pay under ACP Scheme without deputation allowance during the period of deputation, if it is more beneficial than the normal entitlements under the existing general orders regulating pay on appointment on deputation basis.

 

The concerned D.D.O.’s will check and ensure correctness of the due date of upgradation from Service Records of the officers before grant of actual financial benefits.  Any discrepancy may be brought to the notice of this office.

2.               The officers promoted under this order should note that they are liable to be transferred and posted anywhere in the jurisdiction of combined cadre of Ahmedabad-I/II/III /Service Tax & Customs Commissionerate at any time.

 

3.               They will be on probation for a period of 2 years from the date of assumption of charge in the grade of Head Havaldar Group `C’.

 

4.               The above promotions are ordered without prejudice to the claims of other officers, who at a later stage may be found to have prior claims over the above officers in the matter of promotion to the grade of Head Havaldar Group `C’. This promotion confers on them no right for continued retention as Head Havaldar Group `C’ of Central Excise and Customs.

 

5.               The above promotes (except those who have been given Financial benefit in the scale of 3050-4590 under ACP scheme) should note that they should exercise the option for fixation of pay in accordance with the instructions contained in Ministry of Home Affairs, Department of Personnel and Admn. Reforms, New Delhi’s O.M. No.7/1/80-Estt. Part-I dated 26.09.81 as amended from time to time.

 

6.               Those who have already been granted the financial benefit under ACP scheme in the pay scale of Rs.3050-4590, no pay fixation benefit shall accrue to such officers now on account of this promotion in terms of the provisions contained in Assured Career Progression Scheme introduced by Government of India, Department of Personnel & Training O.M. No.35034/1/97-Estt. (D) dated 09.08.99 and clarification issued thereon.

 

7.               In case the officers so promoted to officiate as Head Havaldar Group `C’ do not accept the promotion on or before 31.01.2008 without any valid reason, it will be presumed that they have refused the promotion and accordingly their promotion order would be liable to be cancelled.

 

8.               Even after issue of this order the total working strength of Head Havaldar Group `C’ will not exceed the revised sanctioned strength in the combined cadre of Head Havaldar in Ahmedabad-I/II/III/Service Tax & Customs Commissionerates. Therefore pay of the promotee officers be drawn by the concerned drawing officers irrespective of the sanctioned and working strength in the grade of Head Havaldar in their jurisdiction

 

9.               In case any of the above mentioned officers is facing disciplinary proceeding or court proceeding or if any decision has been taken to initiate any such proceeding which would not have entitled the officer to promotion, then in such cases the officer would be liable to be reverted.

Sub : Appointment of Intelligence Officer in Directorate General of Central Excise Intelligence, Zonal Unit, Ahmedabad on deputation basis – Matter Regarding.

 

In pursuance Memorandum dated 04.02.2008 issued from DGCEI F. No. A-22014/2/2004/AZU by the Additional Director General, Directorate General of Central Excise Intelligence, Zonal Unit, Ahmedabad, Shri A.B. Amin, Inspector at present working in DGCEI, Zonal Unit, Ahmedabad on loan basis is hereby appointed as Intelligence Officer in the Directorate General of Central Excise Intelligence, Zonal Unit, Ahmedabad on deputation basis in the scale of Rs. 6500-200-10500 plus susal allowances with immediate effect and until further orders.

 

2.                        While posted in the Directorate General of Central Excise Intelligence, Shri A.B. Amin, shall not draw or be entitled to any deputation allowances.  Ordinarily the deputation period will not exceed five years.  His continuance on deputation to Directorate General of Central Excise Intelligence will, however, depend on his suitability and actual performance.   He is liable to be reverted any time to his parent Commissionerate on exigencies of service.

 

3.                        While working in the Directorate General of Central Excise Intelligence, Shri A.B. Amin, Inspector will be entitled to special Pay as admissible in term of Ministry of Finance (Department of Revenue), New Delhi’s letter F. No. A-26011/9/86-Ad-IIA(PC) dated 12.08.1997.  He will be entitled to the special pay with effect from the date he joins at DGCEI, Ahmedabad.

 

4.                        Shri A.B. Amin, Inspector is further informed that he will have to make his own arrangements for residential accommodation.

6.               Those who have already been granted the financial benefit under ACP scheme in the pay scale of Rs.3050-4590, no pay fixation benefit shall accrue to such officers now on account of this promotion in terms of the provisions contained in Assured Career Progression Scheme introduced by Government of India, Department of Personnel & Training O.M. No.35034/1/97-Estt. (D) dated 09.08.99 and clarification issued thereon.

 

7.               In case the officers so promoted to officiate as Head Havaldar Group `C’ do not accept the promotion on or before    15.04.2008 without any valid reason, it will be presumed that they have refused the promotion and accordingly their promotion order would be liable to be cancelled.

 

8.               Even after issue of this order the total working strength of Head Havaldar Group `C’ will not exceed the revised sanctioned strength in the combined cadre of Head Havaldar in Ahmedabad-I/II/III/Service Tax & Customs Commissionerates. Therefore pay of the promotee officers be drawn by the concerned drawing officers irrespective of the sanctioned and working strength in the grade of Head Havaldar in their jurisdiction

 

9.               In case any of the above mentioned officers is facing disciplinary proceeding or court proceeding or if any decision has been taken to initiate any such proceeding which would not have entitled the officer to promotion, then in such cases the officer would be liable to be reverted.
