2.                   The officers promoted under this Order should note that they are liable to be transferred and posted anywhere within the jurisdiction of combined cadre of Ahmedabad-I/II/III, Service Tax and Customs Commissionerates, Ahmedabad, at any time.

 

3.                   They will be on probation for a period of 2 years from the date of assumption of charge in the grade of    Havaldar - Group `C’.

 

4.                   The above promotions are ordered without prejudice to the claims of other officers, who at a later stage may be found to have prior claims over the above officers in the matter of promotion to the grade of   Havaldar-Group `C’. This promotion confers on them no right for their continued retention as   Havaldar- Group `C’ of Central Excise and Customs.

 

5.                   The above mentioned officers [except those who have been given Financial benefit in the Pay band of PB-1 Rs. 5200-20200 & Grade Pay Rs. 1800 (Pre-revised  scale Rs. 2750-4400) under ACP scheme] should note that they should exercise the option for fixation of pay in accordance with the instructions contained in Ministry of Home Affairs, Deptt. of Personnel and Admn. Reforms, New Delhi’s O.M. No.7/1/80-Estt. Pt.I, dated 26.09.81, as amended from time to time.

 

6.                   On account of this promotion no pay fixation benefit shall accrue to those officers who have already been granted the financial benefit under ACP scheme in the pay  band  of PB-1 Rs. 5200-20200 & Grade Pay Rs. 1800 (Pre-revised scale Rs. 2750-4400). This is in terms of the provisions contained in Assured Career Progression Scheme introduced by Government of India, Deptt. of Personnel & Training O.M. No.35034/1/97-Estt. (D), dated 09.08.99, and clarifications issued thereon.

 

7.                   In case the officers so promoted to officiate as Havaldar- Group `C’, do not accept the promotion on or before   11 /08/2009  without any valid reason, it will be presumed that they have refused the promotion and accordingly their promotion Order would be liable to be cancelled.

 

8.                   Even after issue of this Order, the total working strength of Havaldar- Group `C’ will not exceed the revised sanctioned strength in the combined cadre of Havaldar in Ahmedabad-I/II/III, Service Tax & Customs Commissionerates, Ahmedabad. Therefore pay of the promotee officers may be drawn by the concerned drawing and disbursing officers (DDOs) irrespective of the sanctioned and working strength in the grade of Havaldar in their jurisdiction.

 

9.                   In case,  any of the above mentioned officers are facing disciplinary proceeding or court proceeding or if any decision has been taken to initiate any such proceeding which would not have entitled the officer to promotion, then in such cases the officer(s) would be liable to be reverted.
