5.               The above promotes (except those who have been given Financial benefit in the scale of 3050-4590 under ACP scheme) should note that they should exercise the option for fixation of pay in accordance with the instructions contained in Ministry of Home Affairs, Department of Personnel and Admn. Reforms, New Delhi’s O.M. No.7/1/80-Estt. Part-I dated 26.09.81 as amended from time to time.

 

6.               Those who have already been granted the financial benefit under ACP scheme in the pay scale of Rs.3050-4590, no pay fixation benefit shall accrue to such officers now on account of this promotion in terms of the provisions contained in Assured Career Progression Scheme introduced by Government of India, Department of Personnel & Training O.M. No.35034/1/97-Estt. (D) dated 09.08.99 and clarification issued thereon.

 

7.               In case the officers so promoted to officiate as Head Havaldar Group `C’ do not accept the promotion on or before   01.09.2008 without any valid reason, it will be presumed that they have refused the promotion and accordingly their promotion order would be liable to be cancelled.

 

8.               Even after issue of this order the total working strength of Head Havaldar Group `C’ will not exceed the revised sanctioned strength in the combined cadre of Head Havaldar in Ahmedabad-I/II/III/Service Tax & Customs Commissionerates. Therefore pay of the promotee officers be drawn by the concerned drawing officers irrespective of the sanctioned and working strength in the grade of Head Havaldar in their jurisdiction

 

9.               In case any of the above mentioned officers is facing disciplinary proceeding or court proceeding or if any decision has been taken to initiate any such proceeding which would not have entitled the officer to promotion, then in such cases the officer would be liable to be reverted.

4.                        The tenure of two years will be counted from 05.09.2008 or any other date extended by the cadre controlling authority.

The Financial benefit granted to the above officers is subject to the following terms and conditions :

1)      The ACP Scheme envisages merely placement in the higher pay scale / grant of financial benefits (through financial upgradation) only to the Government Servant concerned on personal basis and shall therefore, neither amount  functional / regular promotion nor would require creation of new posts for the purpose.

2)      The financial upgradation granted under the ACP Scheme shall be counted against regular promotion.

 

3)      The residency period (regular service) for grant of benefits under ACP scheme shall be counted from the grade in which an employee was appointed as Direct Recruit.

 

4)      The financial upgradation granted is personal to incumbents for the stated purposes of the ACP scheme and is restricted for financial and certain other benefits (House Building Advances / Allotments of Govt. Accommodation / Advances etc.) only without conferring any privileges related to higher status. (e.g.) invitation to ceremonial functions, deputation to higher post etc.

 

5)      The financial upgradation under the ACP scheme granted to above officer is personnel to them and has no relevance to seniority and there shall be no additional financial upgradation for the seniors on the ground that their junior employee in the grade has got higher pay scale under the ACP Scheme.

 

6)      The pay of the above officer shall be fixed under the provisions of FR – 22(1)a (1) subject to minimum financial benefit of Rs. 100/- as per Department of Personnel and Training’s Order No.  1/6/97-Pay.I dated 05.07.1999.  The financial benefit allowed under ACP Scheme is final and no pay fixation benefits shall accrue at the time of regular promotion i.e. posting against functional post in the higher grade.

 

7)      Grant of higher pay scale under the ACP Scheme shall be conditional to the fact that an employee, while accepting the said benefit, shall be deemed to have given his unqualified acceptance for regular promotion on occurrence of vacancy subsequently.  In case he refuses to accept the higher post on regular promotion subsequently, the employee concerned will be reverted from the higher scale granted under the ACP Scheme, as per the instruction contained in point no. 22, of the clarification issued under O.M. No. 35034/1/97-Estt.(D) (Vol.IV) dated 10.02.2000 by the Ministry of Personnel Public Grievances and Pension (Department of Personnel and Training), New Delhi.

 

8)      Before granting ACP benefit, the period of suspension of officers if any,  may please be excluded.

(iii)      The residing period (regular service) for grant of benefits under ACP Scheme shall be counted from the grade in which an employee was appointed as Direct Recruit.

 

(iv)    The financial upgradation granted is Personal to the incumbents for the stated purposes of the ACP Scheme and is restricted for financial & certain other benefits (House Building Advance/ allotment of Govt. Accommodation/ advances etc.) only without conferring any privileges related to higher status (e.g.) invitation to ceremonial functions, deputation to higher post etc.

 

(v)       The financial upgradation under the ACP Scheme granted to above officers is personal to them and has no relevance to seniority and there shall be no additional financial upgradation for the seniors on the ground that their junior employee in the grade has got higher pay scale under the ACP Scheme.

(vii)      Grant of higher pay scale under the ACP Scheme shall be conditional to the fact that an employee, while accepting the said benefit, shall be deemed to have given his unqualified acceptance for regular promotion on occurrence of vacancy subsequently. In case he refuses to accept the higher post on regular promotion      subsequently, the employee concerned will be reverted back from the higher scale granted under the ACP Scheme, as per the instruction contained in Point No.22, of the clarification issued under O.M. In case he refuses to accept the higher post on regular promotion      subsequently, he shall be subject to normal debarment for regular promotion as prescribed in the general Instructions in this regard.  However, as and when he accepts regular promotion there after, he shall become eligible for 2nd upgradation under the ACP Scheme only after he completes the required eligibility, service period under the ACP Scheme in the higher grade subject to the condition that the period for which he was debarred for regular promotion shall not count for the purpose.

 

viii)    The above order is based upon the assumption that there is no vigilance/non-vigilance case pending against the officer. Further, that he /she is not under suspension and not covered by any of the four conditions mentioned in DOPT, New Delhi’s OM no.22011/04/91-Estt(A) dated 14.06.1992. The concerned Commissionerate may kindly ensure that this condition is satisfied before granting of ACP. In respect of officers, where this condition is not satisfied, the order is deemed to not have been issued. Such cases should be brought to the notice of this office immediately.

 

ix)      Before, granting ACP benefit, the period of suspension of officers if any, may please be excluded.

 

                   The concerned D.D.O’s will check and ensure correctness of the due date of upgradation from Service Records of the officers before grant of actual financial benefits. Any discrepancy may be brought to the notice of this office.
