TRADE NOTICE NO. 73/2005
Sub: Prohibition of smoking in public places under provision of “The Cigarettes and other Tobacco Products (prohibition of Advertisement and Regulation of trade and Commerce,
Production, Supply and Distribution) Act, 2003.
Under the Central legislation titled “The Cigarettes and other Tobacco Products (Prohibition of Advertisement and Regulation of Trade and Commerce, Production, Supply and Distribution) Act, 2003.” Section 4 of the said Act prohibits smoking in a public place. Any person violating this provision is liable to be fined up to Rs.200. This provision is being brought into force w.e.f. 01.05.2004. ‘Public Place’ includes any place to which the public has access like auditoria, hospital building, railway waiting rooms, amusement centers, restaurants, public offices, court buildings, educational institutions, libraries, public conveyances, open auditoria, stadia, railway stations and bus stops etc.
In view of the above provision in the new law, all offices are required to take appropriate administrative steps to ensure that there is no smoking in offices and its premises.
Under section 25 of this Act, authorized persons are notified, who are empowered to implement the provision relating to prohibition of smoking in a public place.
All the necessary steps may be taken for strict compliance of the above provision to prohibit smoking in public places.
The Trade Associations/Chamber of Commerce and the Members of the RAC/PGC are requested to bring this to the notice of their members/constituents.
